Bannatyne sells fixed-term contracts, not rolling memberships, and publishes separate terms for 1, 3, 6 and 12-month versions. The structure is identical in each: "the contract between us will last for at least [the term] (referred to in these terms as the 'Initial Fixed Term') and you cannot cancel your membership during the Initial Fixed Term. If you do cancel your membership in the Initial Fixed Term you will breach the contract between us." After it ends, the membership continues in consecutive Subsequent Fixed Terms until someone ends it. To leave normally you use clause 7.3: "You may end the contract between us by giving us not less than 30 days' written notice ending on or after the end of the Initial Fixed Term and expiring at the end of a calendar month." Leaving early without a qualifying reason is handled by clause 7.6, which says the contract "will end 30 days (and to expire at the end of a calendar month) after you give us notice in writing" and "[i]n that case, we will charge you a termination fee" — capped at "your membership fees for the remainder of your Initial Fixed Term less any costs we save and the benefit to us in receiving payment early". Bannatyne states it may charge that fee to a card or collect it from the bank account on your membership application, giving you reasonable notice first.

If you are outside your Initial Fixed Term

    Work out where you are in your Initial Fixed Term. Bannatyne's terms say the contract lasts at least 1, 3, 6 or 12 months depending on which you signed, and that "you cannot cancel your membership during the Initial Fixed Term".

If you are inside your fixed term and have a qualifying reason

    Check your reason against Bannatyne's list. Serious injury or illness likely to stop you using the club for at least two months is covered by clause 7.2, which ends the contract at the end of the month you give notice in.

I sent the form and never heard back.

This is the risk Bannatyne's own form warns about: it does not take effect until Bannatyne has acknowledged receipt, and Bannatyne disclaims responsibility for forms that go astray. The form gives you the deadline to act on — it says receipt will be acknowledged within 7 days and that you should call 0344 477 4777 if it has not been. Resend by email so you have a timestamp, and keep both records.

I stopped the Direct Debit and now I am being chased.

Stopping the payment is not notice, and inside the Initial Fixed Term the terms treat cancelling as a breach of contract. Send the written notice properly, ask for the acknowledgement, and settle the arrears — Bannatyne's terms allow it to recover fees and, where it ends the contract for non-payment, the cost of instructing a debt collection agency.

I want out early because I cannot afford it any more.

That is a documented ground rather than something you have to argue for. Bannatyne's clause 7.1 covers a financial situation that "becomes materially worse than it was at your Joining Date, so that continued membership of the Club is unaffordable", provided you can give reasonable evidence. That route uses 30 days' notice expiring on the last day of the following month, and avoids the termination fee.

What happens after you cancel?

Post-cancellation details like access, downgrade behavior, and refund caveats are shown only when the provider documents them.

  • Bannatyne acknowledges the cancellation form — within 7 days, according to the form — and the form makes that acknowledgement the point at which it takes effect.
  • The membership runs to the end of the calendar month the notice expires in, so expect one more payment in most cases.
  • Prepaid parts of a Subsequent Fixed Term are refunded, minus a proportionate amount for the part already used.
  • If you were inside the minimum term, the liability for the remaining fees does not disappear with the notice — the form says so explicitly.
  • Check the following two statements. A membership that has moved into a Subsequent Fixed Term keeps collecting until the notice is actually processed.

Refund notes

  • Ending outside the Initial Fixed Term does produce a partial refund where you have prepaid. The terms say Bannatyne "will refund you for any part of a Subsequent Fixed Term which you have paid for in advance", while keeping a proportionate amount for the part of that term before the contract ended.
  • Inside the 14-day cooling-off period — available only if you joined online, by email or by phone — Bannatyne refunds all payments received, less "a reasonable deduction" equal to its standard guest pass fee for every visit you made during the period.
  • Ending early without a qualifying reason is the opposite of a refund: clause 7.6 charges a termination fee capped at the remaining Initial Fixed Term fees less costs saved and the benefit of early payment, and Bannatyne may collect it from the card or bank account on your application.
  • If Bannatyne ends the contract because you broke it, the terms refund fees paid in advance but allow deductions for reasonable compensation, including the cost of instructing a debt collection agency.
